A. The Board of Directors shall appoint an Appeals Committee comprised of three (3) or more persons who shall be Members in good standing. The Committee shall hear all appeals regarding violations of the Community legal documents, unless otherwise specified.
B. The appeals process applies to all violations of the Hemlock Farms Code.
C. Any person aggrieved by the imposition of an assessment or fine under the Code may appeal the same to the Appeals Committee.
D. Any appeal of an assessment or fine, shall be made in writing, and filed with or received by the HFCA office within twenty (20) days from the date of notification of the violation.
F. The issuing officer and the appellant must be present. The appelant may have an attorney present. The appellant may also present any witnesses. The Community Association may also present witnesses.
G. When the appellant is not a member, copies of all correspondence shall be sent to the responsible member and that member shall be invited to attend.
H. The Community Manager shall communicate in writing the decision of the Appeals Committee to the Member and appellant within ten (10) days after the next scheduled Regular Board meeting following the hearing. In the event the Appeals Committee denies the appeal the monetary amount will become due and payable within thirty (30) days of the date of notification unless a request for an appeal is made to the Board as described in Section I below. In the event the Appeals Committee upholds the appeal, or recommends a reduced fine, it will make that recommendation to the Board of Directors. The Appeals Committee has the authority to reduce fines when there are mitigating circumstances.
J. The Board of Directors is not required to hear an appeal. It must render a decision; but may do so based on the Appeals Committee Report as well as the appellant/member request letter without a hearing. If it does decide to hear an appeal, it shall be scheduled within one of its next three regularly scheduled monthly Board Meetings. The appellant, the issuing officer or the Community Manager's designee and a member of the Appeals panel must be present.
K. The decision reached by the Board of Directors on the appeal will be final. Notification of the Board's decision will be sent First Class Mail, postmarked within ten (10) days of the date of mailing.
CHAPTER 14 - ANIMALS
(Added 10-18-03)
14-1 Restrictions
No exotic animals, livestock, poultry of any kind, or any other animal not considered a household pet or domesticated animal shall be raised, bred, or kept on any lot or in any building, except that dogs or cats or other household pets may be kept provided they are not kept, bred or maintained for any commercial purpose.
14-2 Enforcement
1. After confirmation by an agent of the HFCA that a violation of this Code has occurred, a written warning shall be sent to the member with ten (10) days to comply after which a citation shall be issued per incident, not per animal if the condition is not corrected.
2. Delivery of the citation or warning shall be immediate where possible. Another copy shall be mailed within the next five (5) business days.
3. Subsequent citations shall be issued every ten (10) days thereafter until the condition is corrected.
4. The Assessment schedule is:

CHAPTER 15 - ARCHITECTURAL AND CONSTRUCTION REGULATIONS

15-1 Purpose
The Architectural and Construction Guidelines of Hemlock Farms will assist in the preservation and enhancement of Hemlock Farms as an appealing residential community. The Guidelines will also provide a common basis for the development and improvement of the community, and will maintain continuity of character and appearance as a means of enhancing the overall value of every property.
15-2 Adoption
The Architectural and Construction Guidelines are hereby adopted by HFCA for the control of all buildings, structures and property improvements. All other regulations, provisions, penalties and conditions are hereby referred to, adopted and made part of this Chapter.
15-3 Authority
The HFCA shall empower the Architectural Committee to develop, maintain and enforce, on its behalf, guidelines and policies as they relate to the construction, prefabrication, alteration, occupancy and maintenance of detached single family dwellings and their accessory structures. In turn, the Committee may employ Hemlock Farms Community Association staff to assist in the maintenance and enforcement of all approved guidelines.
15-4 Definitions
A. Accessory Building or Use - A subordinate use or building customarily incidental to, and located on the same lot occupied by the main use or building. The term "accessory building" may include a private garage, garden shed or barn, private playhouse, private greenhouse, private swimming pool, guest house, caretaker's cottage, or servant's quarters, as hereinafter provided. Where any part of the wall of an accessory building is part of the wall of the main building, or where the accessory building is attached to the main building by a roof, including carports however covered, such accessory building shall be deemed part of the main building.
B. Addition - The building of additional space onto an existing structure.
C. Building - A structure constructed or erected on the ground, with a roof supported by columns or walls. Structures divided by unpierced masonry division walls extending from the ground to the roof shall be deemed to be separate buildings.
D. Construction - The active building, fabricating, physically changing or modifying any home, structure or accessory building.
E. Corporation Counsel - Wherever in the Building Code, shall be held to mean the attorney for the HFCA.
F. Dwelling Unit - Any house or portion thereof designed or used exclusively as the residence or sleeping place of one or more persons and as described in Deed Restrictions.
G. Fence - A barrier of vegetative growth or of other natural or fabricated materials placed or arranged as a line of demarcation between lots or to enclose a lot or a part of a lot.
H. Garage - A building or part thereof used for the storage of one (1) or more vehicles.
15-5 Compliance (Amended 5-17-97, 2-18-06)
All construction and property improvements at Hemlock Farms shall conform with the Deed Restrictions, the By-Laws and Codes of the Association, and amendments made from time to time. Additional construction shall conform with the prevailing local Township building codes and zoning ordinances. In the event that no Township Code exists for a particular Township, the Uniform Construction Code will apply.

15-6 Process
The HFCA shall keep an Architectural and Construction Handbook in force at all times which will describe all procedures and polices as they relate to construction, additions and improvements to properties. The contents of the Architectural and Construction Handbook, and any amendments, will be subject to the approval of the HFCA Board of Directors.
15-7 Right of Entry
The Association in the discharge of its official duties, and upon proper identification, shall have authority to enter any building, structure or premises at any reasonable hour for purpose of ensuring compliance with the procedures and policies of this Chapter.
15-8 Records
The Architectural and Construction records pertaining to a property may be viewed upon submittal of the proper application on file at the HFCA office, and with the written permission of the property owner. It shall be the policy of the Association to pass along costs incurred for researching and providing access to records.
15-9 Liability
A. The Association or the Association's authorized representative, acting in good faith and without malice in the discharge or their duties shall not render themselves liable for any damage that may accrue to persons or property as a result of any act or by reason of any act or omission in the discharge of their duties. Any suit brought against the Association or its employees because of such an act or omission performed in the enforcement of this code shall be defended by the Association until final determination.
B. This code shall not relieve or lessen the responsibility of a property owner, his/her contractor or builder of a building for any damages to the person or property caused by defects, nor shall the Association or its employees be held to assume any such liability by reason of inspection or permits authorized by this code.
C. The HFCA Board of Directors and the Architectural Committee will not assume responsibility for the adequacy of engineering or structural design presented by applicants for new construction, additions or improvements.
15-10 Appeals (Amended 4-28-01, Amended 5-22-04)
A. Any member aggrieved by the imposition of an assessment or fine under this Code, may appeal the same to the Appeals Committee in accordance with Code Chapter 13 - Appeals.
B.. Any Member disagreeing with a decision of the HFCA regarding applications, permits, plans or stop work orders under this Chapter may appeal such decision to the Architectural Committee in accordance with the following procedure:
a. A request for an Appeal Hearing shall be made in writing and filed with or received by the HFCA Office within twenty (20) days from the date of notification stating the reasons for disagreement.
b. Upon receipt of the written request for an appeal within the proper time period, Management shall schedule a hearing within ninety (90) days from the date of the receipt of the request.
c. The appellant shall be notified of the date, time and place of the hearing. The HFCA representative and the appellant must be present. The appellant may have present any additional materials, documentation, testimonials or witnesses. The Community Association may also present witnesses.
d. The Community Manager shall communicate in writing the recommendation of the Architectural Committee to the appellant within ten (10) days after the next scheduled Regular Board meeting following the hearing.
e. Should the appellant disagree with the decision of the Board of Directors based on the Architectural Committee's recommendation, the appellant may request an appeal to the Board of Directors. A request for such Appeal Hearing shall be submitted in writing to the Board within thirty (30) days of the date of the notification and must include a detailed explanation of the reasons for the request (e.g. new information or witnesses that were not presented to the Architectural Committee).
f. The Board of Directors is not required to hear an appeal. It must render a decision but may do so based on the Architectural Committee Report as well as the appellant request letter, without a hearing. If it does decide to hear an appeal, it shall be scheduled within one of its next three regularly scheduled monthly Board Meetings.
g. The decision reached by the Board of Directors on the appeal will be final. Notification of the Board's decision will be sent First Class Mail, postmarked within ten (10) days.
h. All appeal hearings will employ the following procedures and standards:
1. The appellant shall be given a reasonable opportunity to present his/her case.
2. Statements and evidence shall be limited to the items in question.
3. Statements and evidence may be heard from all parties concerned who wish to be heard.
4. The actual hearing dates and continuances are at the discretion of the Architectural Committee and Management.
5. The Appeals Guidelines, as maintained by the HFCA Office and amended from time to time shall be utilized at all Appeals hearings.
C. Upon receipt of the written request for an appeal within the proper time period, the Architectural Committee shall schedule a hearing within sixty (60) days from the date of receipt of the request.
D. The member requesting the appeal shall be notified of the date, time and place of the hearing. He/She may have present any additional materials, documentation, testimonials or witnesses.
E. The Architectural Committee shall communicate it’s final decision to the member within ten (10) days of the closing of said hearing.
F. Should the member disagree with the Architectural Committee's final decision, he/she may further appeal such decision to the Board of Directors. A request for such Appeal Hearing shall be submitted in writing to the Board within thirty (30) days of the date of the Architectural Committee's decision.
G. The Board of Directors shall schedule a hearing on said appeal on the date of its next regularly scheduled meeting, or no later than the date of its following regularly scheduled meeting. time shall be utilized at all Appeals hearings.
15-11 Fees
All fees related to construction, additions and improvements will be included in the Architectural and Construction Handbook.
15-12 Septic System
Approval for the design, construction, and location of all new and replacement septic systems will be the sole responsibility of the appropriate Township Sewage Enforcement Office.
15-13 Chemical Toilets (Added 8-26-03)
Construction and/or use of privies, outhouses or chemical toilets is prohibited on all lots in Hemlock Farms.
Sewage disposal shall be provided by an approved system meeting regulations of the Pennsylvania Department of Environmental Protection.
Exception: Chemical toilets are permitted under a temporary use while a home is under a permitted construction or renovation project. Chemical toilets shall be placed entirely on the member's property and not on the right of way or on the berm of the road.
Exception: Chemical toilets are permitted for seasonal use at HFCA facilities (e.g., ballfields, beaches or where other large events are held) and at 402, Forest Drive and 739 entrance gates.
